WORCESTER COUNTY.

 

appointed for that purpose, by three .weeks previous notice, by
advertisement set up at the court-house door, also at the most
public places of the county, to proceed to offer at public sale
to the lowest bidder, the whole of the public roads in said
county.

Letting out
roads.

SEC. 24. And be it enacted, That the justices of the levy
eourt letting out any road, shall take a recognizance in the
penalty of two hundred dollars, to the state of Maryland, from
the person or persons who may bid off any particular division
of said roads, with one or more sufficient securities, condi-
tioned that the same shall be discharged upon the party or
parties who are the principals therein, keeping the road con-
tracted for in proper order, together with all bridges and foot-
ways across water, where the same may be necessary.

Recogni-
zance to be
lodged in
clerk's
office ;
forfeiture;
penalty.

SEC. 25. And be it enacted, That any recognizance taken
under this act, shall be lodged with the clerk of Worcester
county, within ten days after taking the same, to be by him
recorded in his office ; and at any time when the levy court of
said county or any member thereof, shall know or be informed
of any neglect of duty of any person or persons, the principals
in a recognizance taken by virtue of this act, it shall be the
duty of the said levy court, or the member thereof receiving
the information as aforesaid, to cause a scire facias to issue out
of the county court of said county, upon said recognizance,
against the principal and securities named therein, and if upon
trial, neglect of duty shall be established, the court shall fix
the sum to be paid by the parties named in said recognizance,
and shall give judgment therefor, together with costs of suit,
to be applied towards discharging the county charges of Wor-
cester county.

Compensa-
tion of
supervisors.

SEC. 26. And be it enacted, That the levy court of Wor-
cester county shall, at their first levy in the year eighteen
hundred and twenty-two, and at their annual levy in every
year thereafter, levy and assess on the assessable property in
said county, the sum of ten dollars for every supervisor by
them appointed ; which said sum of ten dollars shall be paid
to each of the said supervisors, or to his order, as a compensa-
tion for his services during the past year ; also such further
sum as may be necessary for the payment of such person or
persons as may have bid off the whole or any district of said

roads ; Provided, that there be in neither of these cases, evi-
dence of unfaithful discharge of the duties required.

Neglect of
duty, &c.

SEC. 27. And be it enacted, That whenever any person or
persons shall be convicted of neglect of duty under this act
or shall die, it shall be lawful for the justices of the levy court,
in their discretion, to rescind the contract made with such per-
son or persons, and to let out the particular division of road
