of Washington county, to keep a ferry from his lands, in said
county, over the Potomac river, to the opposite shore, near or
opposite to the place called the Falling Water; and such
license to renew from time to time, and to fix such rate of fer-
riage as they in their discretion may think proper.

SEC. 2. And beit enacted, That the said ferry, when licensed
by the county court aforesaid, shall be forever thereafter deemed
and taken to be a public ferry, and subject to the same regula-
tions as public ferries now are by the existing laws of this state.

WHEREAS, it is represented to this general assembly by the
petition of sundry citizens of Washington county, that the
establishing of a public ferry at Hancock, across the Potomac
river, would greatly conduce to the public convenience; there-
fore,

Preamble.
|
SEC. 1. Be it enacted, by the General Assembly of Maryland,
That the commissioners of Washington county, be, and they
are hereby authorized and required to establish or cause to be
established, a public ferry across the Potomac river, opposite
to the town of Hancock, in Washington county, and that the
said commissioners shall have power to fix the rate of tolls or
ferriage, and also to increase or diminish the same from time to
time, in such manner as they shall deem most conducive to the

said ferry, as ferryman, who may be willing to perform the
duties required of him by said commissioners, under the pro-
vision of this act, for the rates of ferriage as fixed by the com-
missioners as aforesaid, for the time being, and the person so

appointed shall give bond and security, In the sum of five hun-
dred dollars, conditioned for the faithful performance of his
duties as ferryman, to be approved by the commissioners of
said county, and upon the execution of said bond, the commis-

sioners of said county shall issue a license to the person so
appointed as aforesaid, setting forth the rates of ferriage as
fixed by said commissioners, which the said ferryman shall be
entitled to charge and receive.

SEC. 2. And be it enacted, That it shall be the duty of the
person appointed, as provided in the first section of this act, to
keep a sufficient flat or boat to carry a six horse wagon or other
carriage with its load, and a skiff for foot passengers, and he
shall always furnish a sufficient number of hands to conduct

than one honr, unless prevented by high water or ice, or some
other lawful excuse to be determined by the justice before
