to plead the general issue, and give this act and the special
matter in evidence, and if upon trial the plaintiff or plaintiffs
shall be nonsuited, or shall discontinue his or their suits, then

and in such case the defendant or defendants shall recover costs.
SEC. 5. And be it enacted, That every justice of the peace
shall, at the levy court of his county, account for all sums of
money recovered by virtue of this act, under the penalty of one
hundred dollars.

SEC. 6. This act to continue until the tenth day of October,
eighteen hundred and ten, and until the end of the next session
of assembly that shall happen thereafter.

SHERIFFS.
AN ACT to ascertain the allowance to Sheriffs for keeping Prisoners in
Jail, charged with criminal offences, and finding them Victuals, in the
several Counties therein mentioned. — 1823, ch. 27.

AN ACT to ascertain the allowance of the Sheriff of Somerset County for
keeping Prisoners in Gaol, and to provide for the maintenance of
Debtors actually confined in Prison. — 1836, ch. 174.

Duration.

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That from and after the passage of this act it shall and may be
lawful for the sheriff of Somerset county to ask, demand and
receive, for keeping each prisoner in gaol and finding him or
her in victuals, twenty-five cents per day, and no more, to be
levied and collected as heretofore, any law or usage to the
contrary notwithstanding.

SEC. 2. And be it enacted, That in lieu of the sum of
eighty-seven and a half cents per week, which the said sheriff
is now entitled to receive for the support and maintenance of
every debtor arrested on a capias ad satisfaciendum, it shall and
may be lawful for said sheriff to demand and receive the sum of
one dollar and seventy-five cents per week, to be paid accord-
ing to the provisions of an act, entitled, an act to provide for the
support and maintenance of debtors actually confined in prison,
passed at December session, eighteen hundred and twenty.
