the damages sustained by the person or persona at whose re-
quest such inquisition shall be taken, by transfer of his, hei
or their land about to be made as aforesaid, and the persons so
summoned and so qualified, shall proceed to value the damages
accordingly, and such inquisition shall be conclusive and

 

final ; Provided; that in such appeal from the valuation made
by the commissioners, should the valuation of said commis-
sioners be confirmed or reduced by the jury, by this section
directed to be summoned, the party appealing shall pay the
whole expense incurred thereby.

SEC. 3. And be it enacted, That the commissioners and
jurors aforesaid, shall be allowed for each and every day they
shall be emplpyed under the provisions of this act, two dollars
and costs necessarily incurred, to be collected and paid as
other county charges are.

SEC. 4. And be it enacted, That the commissioners as afore-
said, if there be no appeal from their decision within one
month after said decision is made, or jurors, if there be an ap-
peal, when they shall have completed their valuation, and done
all things required of them by this act, shall make out a copy
of their proceedings, setting forth in the same, a full descrip-
tion of the lands and house by them valued, for the use of the
ferry or ferries, and all things connected with the said valua-
tion, and the performance of the duties assigned them by this
act, and to the said copy they shall subscribe their names, and
set their seals, and deposite the same in the office of the clerk
of the county court, and the said clerk of the said court shall

preserve a record of the said proceedings, for the recording of
which he shall be entitled to the same fee which he receives
for other records, to be paid by the levy court.

Ferries.— 1833, ch. 151.

WHEREAS, sundry citizens of Somerset county have repre-
sented to this general assembly, that the interests of said county
would be greatly promoted by purchasing ferry boats, at the
expense of said county, and the petition of said citizens appear-
ing reasonable ; wherefore,

Preamble.

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That the levy court of Somerset county, are hereby authorized
at their discretion, to purchase or contract for the building
ferry boats, for the public ferries in said county, the cost of
which shall be taxed as other county charges.

SEC. 2. And be it enacted, That the ferryman, who shall be
appointed and licensed by the levy court of said county, shall
enter into bond with sufficient security, to the levy court of
