SOMERSET COUNTY.
 

the commissioners for Somerset county, I will honestly and
faithfully, to the best of my skill and judgment, execute the
duties of said office, without favour, affection or prejudice. So
help me God. Which oath or affirmation, any one of said
commissioners is hereby authorized to administer ; and the

said clerk shall be subjected to the same penalties and for-
feitures for non- performance or neglect of official duty, as are
prescribed by the existing laws in relation as well to the seve-
ral matters which the clerk of the county court of said county
is legally directed and required to do, under the authority of
the levy court, as likewise to those which appertain to the
office of the present clerk of the commissioners of the tax for
said county.

Vacancy of
clerk.

SEC. 6. And be it enacted, That in case of a vacancy occur
ing in the office of clerk to the commissioners, as created by
this act, in consequence of death, resignation, removal or dis-
qualification, the same shall be supplied as soon thereafter as
may be practicable, in the manner prescribed in the preceding
section of this act.

pensation.

SEc. 7. And be it enacted. That the said clerk shall receive
two dollars for every day he shall attend the session of said
commissioners, and such further compensation for official
duties performed on other days, as may be allowed by said
commissioners, not exceeding the rate of one hundred dollars
per annum for such extra service, and shall be removable at
the discretion of said commissioners.

SEC. 8. And be it enacted. That, upon the appointment of a
clerk to the commissioners aforesaid, the clerk of Somerset
county court shall, on demand of the said clerk to said com-
missioners, by order of the said commissioners, forthwith
deliver over to the clerk of the commissioners, all the books,
accounts, papers, and documents belonging or in any manner
appertaining to the levy court of said county ; and shall an-
nually, on or before the first Monday in April, furnish to and

lay before the said commissioners, all the copies of such lists,
accounts, papers and documents as may be useful and neces-
sary to the said commissioners in ascertaining the county
charges, and according to the directions which he may, from
time to time receive from said commissioners, for which ser-
vice he shall have und receive such fees as he, by law, is now
entitled to ; and in case said clerk of Somerset county court

shall neglect or refuse to comply with any of the provisions or
requisitions of this act, when called on by said commissioners,
or their clerk, by their order, he shall, for every such neglect
or refusal, forfeit and pay to the said commissioners, for the
use of the county, the sum of one hundred dollars, to be reco-
