LEVY COURT.

thirty-six, the one drawing ticket number three, to cease being
a member after the first Monday of October, eighteen hundred
and thirty-seven, the one drawing ticket number four, to cease
being a member after the first Monday in October, eighteen
hundred and thirty-eight, and the one drawing ticket number
five, to cease being a member after the first Monday in Octo-
ber, eighteen hundred and thirty-nine ; Provided, that nothing
in this section contained shall be construed to prevent the re-
election of any member of the said levy court.

 

SEC. 2. And be it enacted, That on the first Monday of Octo-
ber, eighteen hundred and thirty-five, the voters of the county
shall proceed to elect a member of the court to fill the vacancy
which shall be created by the place of number one, being
vacated in the same manner as they are now directed to elect

members for said court, and so on, to fill all such vacancies as
may happen, which person or persons so elected, shall hold
their office for the space of five years from their being elected
as aforesaid, except in the cases herein after provided for, and
the sheriff shall give notice as he is now required, that a mem-
ber of the levy court for the district in which the vacancy has
occurred is to be elected, and if any member should die or re-
sign, the governor and council shall fill the vacancy as now
directed, but which appointment shall not be valid longer than
the next election, when the people shall proceed to elect a
member of said court, who shall serve as long as he whose
place he is thus called to fill would have served, and no longer.

vacancy.

SEC. 3. And be it enacted, That each and every member of
the levy court of Queen Anne's county hereafter elected shall
be entitled to receive for each and every day he shall attend as
member of said court, the sum of one dollar and fifty cents, and
in addition thereto an allowance of six and a quarter cents per
mile, for every mile that his place of residence shall be distant
from the place of holding the levy court, and that he shall be
entitled to receive mileage for each and every day he may
attend as a member of said court ; Provided, that nothing in
this act contained shall be construed to allow any member of
said court mileage in returning to his residence.

Compensa-
tion.

SEC. 4. And be it enacted, That the clerk to the levy court
of Queen Anne's county shall be entitled to receive as com-
pensation for his services such sum annually as the levy court
aforesaid may deem proper, not to exceed the sum of two hun-
dred dollars, to be levied on the assessable property of Queen
Anne's county, to be collected and paid over as other county
charges are.

SEC. 5. And be it enacted, That the levy court are hereby
authorized and empowered to employ some proper person
to erect, or cause to be erected, and fitted up in the levy court
