MONTGOMERY COUNTY.

Repeal.

SEC. 10. And be it enacted, That all acts repugnant to or
inconsistent with the provisions of this act, be and the same
are hereby repealed.

Air ACT to amend and explain an Act, entitled, a supplement to an Act,
entitled, an Act to provide for the Public Instruction of Youth in Pri-
mary Schools throughout this State, passed December session, eighteen
hundred and twenty-five, chapter one hundred and sixty-two, so far as
relates 10 Montgomery County.— -1837, ch. 353.

Treasurer
of school
fund.

SEC. 1, Be it enacted, by the General Assembly of Maryland,
That the levy court of Montgomery county, at their next
annual meeting, shall appoint some sensible and discreet citi-
zen of said county, who shall be called the treasurer of the

school fund of Montgomery county, and who shall qualify, by
making oath or affirmation, that he will well and faithfully
discharge the duties required of him by law as treasurer of
the school fund of said county, and not use the said fund
directly or indirectly, to his own advantage; and the said levy

court shall also require the said officer to give bond to the
state of Maryland, with two good and sufficient sureties, con-
ditioned for the faithful discharge of the duties required of
him by law; which bond, being approved by the levy court
shall be filed with the clerk of Montgomery county court; and
any person or persons who deem him or themselves injured
by the omission or acts of said treasurer, shall and may be
entitled to an office copy thereof, and bring suit thereon in the
name of the state, for his use, as in the case of administration
or testamentary bonds ; and a copy of said bond, under seal of
said court, shall be sufficient evidence of the making thereof.

SEC. 2. And be it enacted, That the treasurer of the western
shore, upon receiving a certificate of the appointment of said
treasurer of the school fund, and his qualifying according to
law, from the levy court of said county, shall pay over to the
said treasurer, or his order, annually, the dividends to which
Montgomery county is entitled on the several funds appro-
priated to the purposes of education in this state.

tion of the
fund.

SEC. 3. And be it enacted, That the levy court aforesaid, at
its next annual meeting, shall ascertain and apportion the
amount ol the dividends payable to said county annually among
the several election districts of said county, according to their
free white population ; and the school commissioners of the
several election districts may draw on the treasurer of the
school fund of said county for their respective proportions, to
be applied by them to the purpose of educating the indigent
children of their respective districts, either according to the
primary school system, or such other system as the majority of
the free white voters of the several election districts choose
to adopt.
