SCHOOLS.

AN ACT relatived to the School Fund for Montgomery County, and for the

Education of Poor Children is said County. 1825, ch 181.
This act merges the prior local acts.

 

SEC. 1. Be it enacted, by the General Assembly of Maryland
That Ephraim Gaither, Richard H. Griffith, James Day, Bake,
Waters, William Brewer, Elisha W. Williams, Thomas P
Willson, Otho Magruder, Roger Brook and Thomas Gettings,
be, and they are hereby constituted and appointed commis-
sioners for the purpose of applying and distributing the school
fund appropriated for the education of the poor children, or for
free schools in Montgomery county, as herein after directed.

SEC. 2. And be it enacted, That the orphans court for the
county aforesaid, shall have power, and it shall be the duty of
said court to fill up all vacancies that may occur in the aforesaid
board or list of commissioners, let the said vacancies happen
from what cause soever they may ; and the appointments so to
be made, shall always be made from the election district in
which the vacancy may happen, so that the number of two
commissioners may always be kept up in each district.

SEC. 3. And be it enacted, That it shall be the duty of the
commissioners appointed by this act, or as many of them as may
accept of said appointment, to meet in the town of Rockville
on the second Monday of March next, or as soon thereafter as
practicable, and to organize themselves into a board to super-
intend the important interests confided to their care, by ap-
pointing one of their members to act as president of said board,
and one other of their members to act as secretary and trea-
surer ; and it shall be the duty of the commissioners who may
attend, to inform the orphans court as to the commissioners
who may not attend said meeting, whereupon it shall be the
duty of the orphans court forthwith to make inquiry of the
commissioners who do not attend, whether or not they accept
said appointment ; and in every case of non-acceptance, to
proceed to make new appointments in the manner herein be-
fore directed, certifying all appointments so made under thd
signature of the chief justice of said court, and giving informa-
tion to the persons appointed ; and it shall be the duty of said
board of commissioners from time to time to certify the orphans
court of all vacancies that may occur in said board, and it shall
be the duty of said commissioners to call on the treasurer of
the western shore for an estimate of the amount that will be-
come due to the county on the first day of December next, on
account of the school fund, distinguishing what part thereof
will be due to the county as their annual share of said fund,
under the law of eighteen hundred and thirteen, chapter one
hundred and twenty-two, and what part thereof as interest or
