AN ACT to repeal the Act of Assembly, passed at December session,
eighteen hundred and eighteen, chapter eighty-nine, so far as relates to
Somerset and Dorchester Counties.— 1823, ch. 123.

 

Be it enacted, by the General Assembly of Maryland, That
the act of assembly, passed at December session, eighteen hun-
dred and eighteen, chapter eighty-nine, as far as the same re-
lates to Somerset and Dorchester counties, be, and the same is
hereby repealed.

AN ACT to repeal an Act, entitled, an Act to exempt the Servants of
Overseers of the County Roads in Dorchester County, from doing duty
on said Roads, passed at December session, one thousand eight hundred
and twenty-three, and for other purposes. — 1826, ch. 10.

AN ACT to authorize the erection of Gates on the Public Road therein
mentioned in Dorchester County. — 1826, ch. 104.

Repeal.

WHEREAS, it is represented to this general assembly, by the
petition of sundry inhabitants of Dorchester county, that much
inconvenience, as well as serious injury, is sustained by reason
of their stock passing from the extensive marshes in Meekin's
Neck, in said county, by way of the county road, into the
forest near Black Water river, where the stock is frequently
lost entirely, to the great prejudice of the owners in that part
of the county where your petitioners reside, and for want of
some legal authority to keep a gate or two on said county road ;
your petitioners pray legislative aid to remedy the serious
inconvenience under which they labour ; therefore,

Preamble.

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That from and after the passage of this act, it shall and may be
lawful for any citizen or citizens of Dorchester county to erect
and keep, on the public road leading through Meekin's Neck
to the head of llungar river, two gates, one at Poplar Neck
near John Tubman's store-house, and the other at a place called
the Great Marsh Bridge, for the use and pur poses before herein
recited, upon the express conditions following : all and every
owner or owners of a gate or gates, kept on the public roads,
shall have his, her, or their gate or gates hung on good and
sufficient iron hinges, and shall keep the same, and that part of
the road on which they are erected, and which is occupied
thereby, in good order and repair ; but it is not hereby intended
to compel the citizens, who erect and put up such gates, to
keep up the whole road between such gates, but only that part
on which they stand, so as to impede, as little as possible, per-
sons travelling said road with carriages of pleasure or burthen.

SEC. 2. And be it enacted, That if any person or persons,
after the passage of this act, shall cut down, destroy, wilfully
leave fixed open, or remove any of the said gates, they shall,
