entitled to receive a portion of the donation, the distribution
of the whole amount of the donation allowed to any one dis-
trict, under said act of December session, eighteen hundred
and thirty-one, chapter two hundred and fotty-four, would
give to any one of the located and entitled schools in such dis-
trict, moie than one hundred dollars, the orphans court shall

 

pay to such school only the sum of one hundred dollars as its
proper proportion, so that the annual proportion of any one
located school shall never exceed that sum \ and that if after
distributing said donation amongst the located schools, accord-
ing to the provisions of said act and this supplement, there

should remain a surplus of said donation, the same, with any
surplus which may accrue from year to year, shall be suffered
to accumulate in the hands of the orphans court of said county,
until the expitatton of every third year, beginning with the
next June session of said court, and at the expiration of said
period, such accumulated surplus shall be equally distributed
amongst all the then located and entitled schools in said county,
first deducting for the use of the said schools in the middle dis-
tiict, the sum of fifteen dollars of every three hundred dollars
of such surplus.

SEC. 13. And be it further enacted, That when any such
house has been built at any located point, in conformity to the
provisions of the fifth section of the act of December session,
eighteen hundred and thiity-one, chapter two hundred and
forty-four, such school shall be entitled by the certificate of
the tiustees of the building of the school-house under that
section, and without any certificate as to the number of
scholars, to their distributive proportion of the donation for the
first year after such certificate, which they may apply to defray
the expense of building said house, but they shall not, after

orphans court of Caroline county, shall pay semi-annually at
their June and December sessions of said court, to the several
located schools of said county, who are entitled to a portion of
the state's donation, their respective proportions of said dona-
tions then in the hands of said justices ; and if the said justices
