Disposition
thereof.

SEC. 6. And be it further enacted, That in the distribution of
said fund, instead of the mode directed by the seventh section
of the act of eighteen hundred and twenty-one, chapter one
hundred and thirty-nine, it shall be the duty of the several dis-
trict commissioners appointed under this act, diligently to in-

quire for and ascertain such orphans and poor children, as are
destitute of the means of education, and to select from time to
time, and as far as the funds under their control will enable
them, such orphans and poor children as they may deem pro-
per objects for education, out of said fund ; and that it shall be

their duty to give to those whom they may select, an order for
their reception and tuition, at any school nearest or most con-
venient to such scholar ; and that such selection may be made,
and orders for the reception of charity scholars, given, either
by the board of commissioners for the district, or any member
thereof; and that upon any such order or orders accompanied
with the account or accounts of any teacher or teachers, for the
tuition money due under said order or orders, which account or
accounts shall be verified by the affidavit or affidavits of any such
teacher or teachers, it shall be the duty of the board of com-
missioners for the district to give such teacher or teachers an
order upon the justices of the orphans coutt for said county,
which it shall be the duty of the said justices to pay, out of any
money in their hands standing to the credit of the commis-
sioners of said district, and to take and deposite such order
with the vouchers of its payment, with the register of wills, to
to be by him preserved amongst the other papeis relative to
this fund in said court.

SEC. 7. And be it further enacted, That it shall be the duty
of the said several boards of district commissioners to return
annually, to the justices of the orphans court of said county, at
their June session, a full report of all their proceedings under
this act, signed by at least a majority of the commissioners, in
which they shall set forth particularly the whole number and
names of the charity scholars, to whom orders for tuition were
given during the preceding year, the number of scholars of
each sex, and the several schools to which the orders were
given, and which report shall be accompanied by all the ac-

counts of the teachers at verified by affidavit as aforesaid, upon
which orders to the orphans court were granted ; and that
upon failure to produce the accounts so verified with their re-
port, the board of commissioners, giving the orders for which

accounts so verified are not produced, shall be held liable for
the amount of such orders, which the justices of said orphans
court, for the time being, may recover from them, by action of
debt, instituted against them in the name of the state, or the
county court, and before any justice of the peace of said
