SCHOOLS.

said school to give notice by public advertisement, to be set up
at two or more public places in said section, of the time of the
commencement of said school, and that all such white persons,
residents in said sections, who may choose to send their chil-
dren, or any orphan children who may reside in said section
and being under the directions of any white resident of said
section, whose age does not exceed fifteen years, shall be taught
gratis, which said terras shall be expressed in said public notice ;

Provided always, that no child or children shall be taught
beyond the double rule of three gratis, without the consent of
the trustees of said school ; all notices given by virtue of this
act shall be signed by the president of the board of trustees for
the time being.

Proviso.

SEC. 14. And be it enacted, That in case the voters shall
neglect to assemble according to the provisions of this act, and
elect new trustees, the trustees in office shall continue to act
until the voters shall have made such new election, which shall
be lawful for them to do as soon thereafter as conveniently
may be.

SEC. 15. And be it enacted. That in case of the death, re-
signation, or refusal to act, of either of the said commissioners,
then and in that case the levy court of the said county are
hereby empowered and directed to appoint a person or per-
sons, residing in said county, to supply the vacancy.

A further SUPPLEMENT to an ACT, entitled, an Act for the distribution of
a certain Fund for the purpose of establishing Free Schools in the
several Counties therein named, and for other purpose. — 1821, ch. 139.

Vacancies.

WHEREAS, by an act entitled, an act to incorporate a com-
pany to make a turnpike road leading to Cumberland, and for
the extension of the charters of the several banks in the city of
Baltimore, and for other purposes, and its supplements, a fund
has been pledged for the establishment of free schools through-
out this state, the said act and its several supplements have di-
rected that the said fund should be equally divided among the
several counties of this state ; And whereas, by the act to which
this is a supplement, a certain number of commissioners are
named and appointed in and for each of the several counties of
this state, for the purpose of carrying the objects of the said law
and its several supplements into effect; therefore,

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That from and after the passage of this act, all the power and
authority vested in the commissioners named and appointed as
aforesaid for Caroline county, shall cease and determine ; and
that all the power and authority which was vested in the com-
missioners aforesaid by the act aforesaid, shall be, and is
hereby vested in the justices of the orphans court for Caroline
county, and their successors.
