COUNTY COURT.

1868

SEC. 4. And it enacted, That whenever at any term in the
opinion of the judges of said county court, it shall be deemed
proper, the said county court may from time to time, order
another jury to be} summoned to said court in addition to the
regularly attending jury of the Jerm, for the trial of any causes

tried before such additional jury which any of the parties by
counsel or otherwise shall at the first call of the trial docket,
require to be tried before the regularly attending jury aforesaid,
and all such causes so required to be tried, shall be so tried, if
practicable, and while trying no cause shall be tried before an
additional jury as aforesaid ; and all the rules applicable to juries
generally in such court shall apply to such additional juries.

A further SUPPLEMENT to an ACT, entitled, an Act for the despatch of
Business in Baltimore County Court. — 1836, ch. 133.

Proviso.

SEC. I. Be it enacted, by the General Assembly of Maryland,
That the provisions of the second and third sections of the act
passed at December session, eighteen hundred and thirty-five,
chapter two hundred and thirty-five, shall hereafter extend to
all cases of insolvent debtors in the city of Baltimore, which
are pending in Baltimore county court, and in which the trus-
tees of such insolvent debtors shall not have distributed the
funds and effects belonging to their trust, or otherwise closed
their tru§t; Provided, that in allowing commissions to such
trustees, the court shall allow the same commissions to which
trustees would have been entitled under the provisions of the
tenth section of the act passed in eighteen hundred and five,
chapter one hundred and ten; And provided further, that so
much of the supplement as extends the operation of the second
and third sections of the act aforesaid, shall not be applied to
those trustees heretofore appointed, who shall, within the term
of twelve months from their appointment, or from the receipt of
undistributed funds by them, apply to said court, or to some
court of equity, for an audit or investigation of their account*
or for permissions, directions or instructions, either to distribute
or invest the funds in their hands.

SEC. 2. And be it enacted, That the power and authority of
Baltimore county court, to appoint a special auditor in cases of
insolvency, and to superintend and direct the distribution of the
estates of insolvent debtors, shall be deemed to be concurrent
with that of the courts of equity in this state*
