commissioners may dispense with the payment of said fee of
one dollar whenever they are satisfied of the pecuniary inability
of the petitioner to pay the same.

SEC. 2. And be it enacted, (doubts existing, whether city
cases of petitions for divisions of deceased persons' estates are
within the provision of the eighth section of the act to which
this is a supplement,) that in filing any such petition there
shall be paid to the clerk of Baltimore county court the sum of
two dollars, to be paid over and accounted for by said clerk, as

or trustees of an insolvent debtor of the city or county of Balti-
more, has instituted or shall have instituted any suit or proceed-
ing as such trustee or trustees, in law or equity, and any trustee

trustees, as if no such appointment had been made ; and such
appointment shall not abate and shall not in any wise affect
such suit or proceeding ; and that if after such appointment,
such suit or proceeding shall be conducted in the name of such
former trustee or trustees who shall depart this life, the new
trustee or trustees shall be entitled to be made and entered, and
appear as plaintiff or plaintiffs in place of the deceased : and so

fendants in any suit or proceeding as aforesaid, it shall be
