if one or more shall have died after the rendition of such judg-
ment, for the same amount of debt, damages and costs, or
damages and costs, on the same conditions of release, as the
case may be, to be paid in two equal payments ; that is to say,
one moiety of the whole original debt, with interest thereon, in
six months, and the other moiety of such debt, with interest,
and all costs, in twelve months after the date of such confessed
judgment, it shall be the duty of the said clefk to enter of re-
cord, on a separate docket to be kept for that purpose, and
indexed in the name of each of the parties, such confession of
judgment, and to examine, if he shall deem it necessary, on oath,
or affirmation, which he is hereby empowered to administer, as
to the sufficiency of the sureties, and he shall be entitled to re-
ceive, at the time of taking and entering such confessed judg-
ment, the same fees as are allowed by law for similar services;
and such confessed judgment shall be as effectual as any judg-
ment entered or rendered in open court, and shall operate as a
supeisedeas and stay of execution on the original judgment, and
the several portions of it, agreeably to the terms and conditions
mentioned in such confessed judgment, and execution may
issue thereon for each respective portion or moiety thereof, if

 

not paid when the same shall become due; Provided, that if
any execution, issued on the original judgment, shall be ac-
tually served before the entry of the judgment so operating as
a superscdeas, the sheriff, oi other officer, serving the same,
shall be entitled to receive his legal fees and commission for
such service from the defendant or defendants, and the said
court may regulate the form in which every confession of judg-
ment as aforesaid shall be entered or recorded, and the form of
certificate to be given by the clerk of such entry.

Proviso.

Snc. 12 And be it enacted. That if any person residing
within the limits of the city af Baltimore, shall hereafter be
summoned as a witness in any cause pending in Baltimore
county court, and shall attend said court, such person shall be
entitled to receive, from the party summoning him or her, the
sum of fifty cents for each and every day's attendance; and if
any person residing without said limits, shall be summoned and
attend as aforesaid, such person shall be entitled to receive,
from the party summoning him or her, the sum of one dollar
for each and every day's attendance, and such mileage as is
now allowed by law.

SEC. 13. And be it enacted, That this act shall be and con-
tinue in force until the first day of December, 1834, and until
the end of the next session of the general assembly that shall
happen thereafter.
