the same are hereby repealed, and that the aforesaid act, enti-
tled, an act for the better regulation of the militia of the city Of
Baltimore, passed at December session, eighteen hundred and
twenty-three, chapter one hundred and eighty-eight, and the

supplements thereto, passed at December session, eighteen hun-
dred and twenty-five, chapter fifty-six, and chapter two hun-
dred and eighteen, be, and they are hereby declared to be in
force in the city of Baltimore, except so far as the provisions
thereof may be repealed by this act, or be inconsistent with the
provisions herein after contained.

SEC. 2. And be it enacted, That all able-bodied white male
citizens, between the ages of twenty-one and forty-five years,
residents of the city of Baltimore, and not exempted by the first
section of the act of eighteen hundred and twenty-three, chap-
ter one hundred and eighty-eight, shall be and they are hereby
formed into two divisions, one whereof shall be the third divi-

sion, and the other to be raised, shall be called the first light
division of Maryland volunteers.

SEC. 3. And be it enacted, That the third division shall con*
sist of all the brigades now attached to it, except the first light
brigade of Maryland volunteers, which said brigade, together

with a new brigade to be raised, and to be called the second
light brigade of Maryland volunteers, shall constitute the first
light division of Maryland volunteers, for which said new divi-
sion, the governor and council shall issue commissions for a
major-general, with the usual division staff officers, and for
which said new brigade, the governor and council shall issue
commissions for a brigadier-general, with the usual brigade
staff officers as herein after directed.

SEC. 4. And be it enacted, That the second light brigade of
Maryland volunteers, shall consist of the first regiment of rifle-
men, heretofore attached to the first light brigade, and of a new
regiment of infantry, to be called the fifty-third regiment of
volunteer infantry, for which new regiment of infantry, the
governor and council shall issue commissions to the usual field,
regimental, staff and company officers as herein after directed;
the said regiment to be under the same regulations in every
respect, and to have the same privileges as the fifth regiment of
volunteer infantry which now forms part of the first light
brigade.

SEC. 6. And be it enacted, That previous to the appointment
of a major-general of said first light division he shall be recom-
mended to the consideration of the governor and council by the
general and field officers attached to that division, in tho man-
ner directed in the case of the recommendation of a brigadier-
