Payment
therefor.

SEC, 2. And be it enacted, That upon making said purchase
and contracts for the improvements aforesaid, and upon the
bona fide execution thereof, by the other party or parties to the
same, it shall be the duty of the said commissioner to make

report thereof to the governor, and to draw, with his approba-
tion, in writing, upon the treasurer of the western shore for
such sum or sums as may be due on account of the said pur-
chase and improvements, and pay over the same to the persons
claiming and entitled thereto ; and the said treasurer is hereby
directed to pay such sum or sums to the aforesaid commis-
sioner, or his order, out of any unappropriated money in the
treasury.

SEC. 3. And be it enacted, That the commissioner aforesaid
shall, before he enters upon the execution of the trust aforesaid,
execute a bond to the state, with security, to be approved by
the governor, conditioned for the faithful performance thereof,
.and when the said trust shall have been discharged by him, he

shall receive compensation for the same, at the rate of four dol-
lars per day, for each and every day necessarily spent by him
in attending to the same, to be paid in the manner and under
the limitations herein before provided.

SEC. 4. And be U enacted, That the governor when apprised
of the completion of the aforesaid improvements, by the report
of said commissioner, be, and he is hereby authorized and
required to appoint, with the consent of the senate, and an-
nually thereafter, a suitable and proper person to be weigh-

master of live stock in the city of Baltimore, whose duty it
shall be promptly to weigh and determine the gross weight of
all beef, cattle and hogs which may, after the date of his taking
the requisite oath of office, and giving bond to the state, be
driven, or carried alive to said city for sale and slaughter, and
he shall give a certificate under his hand, setting forth the
actual gross weight of any number of cattle or hogs so weighed
by him, to their owner or his agent, and shall keep a correct
official record of the number and weight of all beef, cattle and
hogs so weighed, and for whom, together with a true account
of all receipts and expenditures arising from or connected with
the duties of his office.

SEC. 5. And be it enacted, That the weigh-master is hereby
authorized to charge and receive payment for weighing live
stock as aforesaid, at the rate of three cents per hundred, and

upon failure or neglect of any owner or agent to pay said charge
or any part thereof, it shall be lawful for said weigh-master to

impound any number of cattle or hogs which he may deem
necessary to pay or cause said charge to be paid; Provided
however, that no injury be done to said stock by confining them
as aforesaid, and that they shall be delivered to the owner or
his agent upon payment of all just and proper charges.
