BALTIMORE CITY.

Members of

f SEC. 2. Be it enacted^ by the General Assembly* That the

second
branch of

persons in the several wards of the said city, qualified to vote

city council

for members of the first branch of the city council, shall, on

SEC. 3. And be it enacted, That the mayor of the said city

chosen.

shall be chosen in the following manner, to wit: The persons

 

qualified to vote for members of the first branch of the city

 

council, shall, on the first Monday in October next, and on the

 

same day in every second year thereafter, assemble at the place

 

of holding elections in their respective wards in the city of

 

Baltimore, and elect, by ballot, sixteen persons qualified to be

 

members of the first branch of the city council as electors of

 

the mayor of the said city, two of whom shall reside in each of

 

the said wards, which said electors shall, on the first Monday

 

in November next, and on the same day in every second year

 

thereafter, meet at some convenient place jn the city of Balti-

 

more, and by ballot elect a mayor, to serve as such for two

 

years next thereafter ; and no person shall be eligible as mayor,

 

who is not of known integrity, experience and sound judg-

 

ment, twenty-five years of age, ten years a citizen of the United

 

States, five years a resident in the city of Baltimore next pre-

 

ceding the election, and assessed on the books of the assessor

 

with property in the city of Baltimore to the amount of five

 

hundred dollars ; and in case two or more persons shall have

 

an equal number of votes for the mayor, the said electors shall

 

determine, by lot, which of the persons, so having an equal

 

number of votes, shall be appointed to the office of mayor; and

 

the said electors, before they proceed to the said election, shall

 

swear, or affirm, as the case may be, that they will elect, without

 

favour, partiality, or prejudice, such person for mayor, as they,

 

in their judgment and conscience, believe best qualified for the

 

office, and having other qualifications required by this act; that

 

the said electors shall be judges of their own elections, returns

 

and qualifications ; but no person who is a member of either

 

branch of the city council, or holds any office of profit in the

 

said corporation, shall be eligible as elector of the mayor; and
