the authority of the same, That in all actions and prosecutions
hereafter to be commenced against any person or persons for
unlading or casting out any ballast contrary to the said act, it
shall and may be lawful for tile justices of the court in which
such action or prosecution shall be commenced, upon affidavit
or other evidence of such offence, given to the satisfaction of
such court, to award special bail, or security, as the case may
require, and in default of such bail or security to commit the
offender to the custody of the sheriff until he shall put in such
bail or security as is usual in other cases, any law or usage to
the contrary notwithstanding.
SEC. 3. And be it further enacted, That if a verdict pass
against such offender, judgment on confession or by default be
rendered against him, the plaintiff or informer shall recover
full costs.
CHAPTER 28.
AN ACT for the relief of Insolvent Debtors.
Repealed with all of its supplements, by 1817, ch. 183.

FEBRUARY, 1777.—CHAPTER 5.
AN ACT to direct the forms of the commissions to the Judges and Justices
and civil officers of this state, and the oath of office to be taken by the
Governor, the Chancellor, Judges, Justices, and all civil officers of this
slate.
Plaintiff to
recover
costs, &c.
Be it enacted by the General Assembly of Maryland, That
the governor, chancellor, judges, justices, and all other civil
officers of government, shall take the following oaths respec-
tively, before they enter into the execution of their respective
offices. The oath of the governor: 'I, A. B. elected governor
of the state of Maryland, by the senate and house of delegates
thereof, do solemnly promise and swear, that I will, to the best
of my skill and judgment, execute the said office diligently and
faithfully, according to the constitution and laws of the said
state, without favour, affection or partiality; and that I will, to
the utmost of my power, support, maintain and defend, the
state of Maryland, the constitution and laws, the freedom and
independency thereof, against all open enemies, or secret and
traitorous conspiracies, and will constantly endeavour to protect
the people thereof in the secure enjoyment of all their rights
and privileges; and that the laws of the state be duly observed,
and that law and justice, in mercy, be executed in all judg-
ments, and that I will peaceably and quietly resign the office of
governor, to which I have been elected, at the period to which
my continuance in the said office is or shall be limited by law
