CHAPTER 105.
A SUPPLEMENT to an ACT, entitled, an Act, for the preservation of Wild
Fowl, in the Potomac River and its tributary streams, passed at Decem-
ber session, eighteen hundred and thifty-two, chapter one hundred and
thirty-four, and extending the provisions of this and the original act to
the Paluxent River.

 

SEC. 1. Be it enact 'ed, by the General Assembly of Maryland,
That from and after the first of October next, in all cases of a
violation of the provisions of the act to which this is a supple-
ment, it shall be the duty of such justice of the peace of this
state as shall be applied to for that purpose, forthwith to issue a
warrant in the name of the state of Maryland, against any per-
son charged with the violation of said act, in the same manner

plying for such warrant shall make oath before such justice
that he is informed and believes that the person so charged has
been guilty of the violation of said act.

SEC. 2. And be it enacted, That upon the appearance of the
person accused, and of such witnesses as may be required on the
part of the prosecution, and the accused before the said justice, or
any other justice of the peace for the county, wherein the accused
may be arrested, it shall be the duty of the said justice of the
peace to try and decide upon the said charge or charges, con-
tained in the body of the warrant, and any person so adjudged
guilty of a violation of the provisions of the said act, to which
this is a supplement, shall in addition to the forfeiture of the
gun as therein prescribed, be fined by said justice of the peace,

shall be committed by said justice to the jail of the county
where such conviction shall take place, there to remain until he
shall pay or cause to be paid to the sheriff of such county the
