SEC. 5. And be it enacted, That the act, entitled, an act to
declare and ascertain the right of citizens of this state to pri-
vate roads, passed at November session, seventeen hundred and
eighty-five, chapter forty- nine, be, and the same is hereby re-
pealed.

CHAPTER 257.
AN ACT supplementary to an Act,* relating to taking Supersedeas, and
making valid the same.

SEC. I. Be it enacted, by the General Assembly of Maryland,
That from and after the passage of this act, it shall be lawful
for any justice of the peace, taking any supersedeas of a judg-
ment of a justice of the peace, to take one or two surety or
sureties, as in his discretion he may deem proper.
SEC. 2. And be it enacted, That every supersedeas heretofore
taken by any justice of the peace, with one surety, shall be as
effectual to every purpose as if two sureties had been taken
therein.

CHAPTER 266.
A SUPPLEMENT fo an ACT, entitled, an Act to prevent the unlawful
Exportation of Negroes and Mulattoes and to alter and amend the Laws
concerning Runaways, passed at December session, eighteen hundred
and seventeen, chapter one hundred and twelve.

 

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That the provisions of the second section of the act of the
general assembly of Maryland, passed at December session, in
the year eighteen hundred and seventeen, chapter one hundred
and twelve, be, and they are hereby extende,d to all cases where
any person, being a resident of this state, shall purchase or
receive, on any contract, any servant or slave, who is, or may
be entitled to freedom after a term of years, or after any particu-
lar time, or upon any contingency, knowing that such servant
or slave is so entitled to freedom, with an intention to transport
such servant or slave out of the state; and to all cases where
any person, being a resident of this state, shall remove such
servant or slave out of this state, and shall sell the same, know-
ing the said servant or slave to be so entitled to freedom ; and
all the provisions of said act are hereby declared to apply to
the case of such person residing in this state, to every effect, as
if such case were originally embraced in the terms of said
second section.

SEC. 2. And be it enacted, That nothing contained in this
act, shall be construed to repeal any part of the act, passed at
December session, eighteen hundred and thirty-three, chapter
two hundred and twenty-four.
