exempt from being draughted, by reason of his having per-
formed a tour of duty as a substitute.

SEC, 35. And be it enacted, That the commanding officer of
each company, shall appoint and dismiss at his pleasure, his
non-commissioned officers; and if any person so appointed,
shall neglect to do the duties of his appointment, or refuse or
neglect to obey the orders of his superior officers, or any of
them, he shall forfeit and pay a sum not less than five dollars,
nor exceeding twenty dollars, in the discretion of such court
martial, as the case may require, which fine shall be collected
and paid over by the sheriff of his county, as other fines are
herein directed to be collected and paid over by him.

Annual drill

SEC. 36. And be it enacted. That in addition to the company
meeting for inspection, herein before directed to be held by
every uniformed and draughted company of the militia of this
state, on the second Saturday of May, in each and every year,
there shall be another meeting of said companies for drill, in
their respective battalions, squadrons, regiments, or brigades, as
the field and staff officers of said corps, or a majority of them,
shall decide ; and the said meetings shall be held on the third
Saturday of September, in each and every year.

Duty of
adjutant.

SEC. 37. And be it enacted. That it shall be the duty of the
adjutant of each regiment, extra battalion, or squadron, to attend
and execute the orders of the commanding officer of the regi-
ment, extra battalion, or squadron, necessary to carry into effect
the provisions of this law, and the orders that he may receive
from the adjutant-general, for the purpose of making or obtain-
ing perfect returns of the arms and accoutrements of each com-
pany in said corps, or either of them; and upon refusal or

neglect, he shall be subject to a fine not exceeding twenty dol-
lars, nor less than five dollars, at the discretion of a regimental
court martial, unless he can make a satisfactory excuse to said
commanding officer, or the adjutant-general, as the case may
be; and which fine shall be collected and paid over by the
sheriff of the proper county, as other fines are directed to be
by this act.

Place of
parade.

SEC. 38. And be it enacted, That the companies of each regi-
ment, battalion, or squadron, of uniformed or draughted militia,
shall have their meetings, respectively, for drill, as prescribed
by this act, at some convenient place, which shall be desig-
nated by the commanding officer of each regiment, battalion, or
squadron; where they shall be formed into regiments, batta-
lions, or squadrons, as the case may be, and marched to the
place of exercise and parade, and delivered over by the com-
manding officers of squadrons, battalions, or regiments, to the
commanding officer of brigade or regiment, as the case may be,
who shall exercise, or cause the same to be exercised, accord-
