the sum claimed does not exceed one hundred dollars ; or in the
proper county court, when the sum claimed exceeds one hun-
dred dollars; and the damages which shall be recovered on such
proceedings against the commanding officer of a company, shall
be collected by the sheriff of the proper county, and be by him
paid over to the treasurer of the western shore, and the damages
which shall be recovered against any sheriff shall be collected
by such civil officer as the adjutant-general shall designate for
the purpose ; and such officer shall forthwith pay over to the said

treasurer the money which he shall collect, first deducting a
commission of ten per centum therefrom.

SEC. 22. And be it enacted, That it shall be the duty of every
sheriff to require and obtain from each of his deputies, instructed
to collect militia fines, forfeitures, and penalties, a return, on
oath, at least once in two months, of all the money which such
deputy had collected, as and for such fines, forfeitures, and pen-
alties, and each deputy sheriff who shall collect any of said

fines, forfeitures, and penalties, and neglect to make a return
thereof, under oath, to his principal, for the space of three
months after he shall have collected the same, shall forfeit and
pay, to the use of the state, the sum of one hundred dollars,
which shall be collected by the sheriff who appointed him, un-
less the same shall be remitted by the adjutant-general; and if

riot so remitted, the said sheriff shall collect and pay over said
forfeiture without delay to the treasurer of the western shore ;
and each sheriff shall be entitled to retain ten per centum out of
all moneys that he shall collect under this act; and shall pay
over, quarter-yearly, to the treasurer of the western shore, the
balance of the money so by him collected.

SEC. 23. And be it enacted, That the treasurer of the western
shore shall keep an account of all the money which shall be
collected from the militia of this state, and be paid over to him,
as and for fines, forfeitures, and penalties ; in such form as will

best show how much money was received by him on account of
injuries to or loss of arms and accoutrements that belong to the
state, and how much on account of fines, forfeitures, and pen-
alties, and of this, how much was paid by the privates and
officers of the several companies, extra battalions, squadrons,
regiments, brigades, and divisons, of said militia, and so as that
the surplus of fines, forfeitures, and penalties, at any time re-
maining in the treasury, after paying such expenses as shall by

law be charged on this resource, may be distributed rateably
among the said several corps in just proportion to the aggregate
collections made from them respectively, when, and as the same
