184        APPENDIX.

    1st.  In the case, where no executors are appointed
in the will, thus!--Without appointing
any executor thereof; We do therefore, &c.--
 
    2d.  Where the appointed executor doth refuse
to act, thus!--and therein and thereby did
constitute a certain
                    to be his executor thereof, which said
                                                                          hath
since in due form of law renounced, and refused to
take upon him the burden of said executorship; We
do therefore, &c.
 
    3dly.  Where the appointed executor is
dead, thus--and therein and thereby did constitute
a certain
to be his executor thereof, which said
                                        is since also deceased, as it is
said, without taking letters testamentary on said
estate; We do therefore, &c.
