THE word Administration is not known in
the civil, or canon law, in any other
sense, than as relative to publick Government;
neither was it known in the law of England,
before the statute of Edward the 3d. but as it
would be a matter, rather of curiosity, than of
use, to give a distinct, historical account by
whom, under what pretences, and in what
manner, the goods of intestates were formerly
disposed of in England, I shall not enter into
that large field; but proceed to observe that,
by the statute of 13th. Edward 1st. cap. 19,
it was enacted, " where a man dies intestate,
" and in debt, and the goods come to the ordinary
" to be disposed, he, the said ordinary, shall
" satisfy the debts, so far as the goods extend,
" in such sort, as the executors of such persons
" should have done, in case he had made a
" will," &c.
