Which was read and adopted.

Mr. Tome submitted the following amendment:

Provided, that if said road should be constructed over nav-
igable waters, said company is required to build a draw in
the most navigable part of said stream to pass vessels by day
or by night through said bridge or bridging, free of charge.

Which was read and adopted.

The bill was then read the third time and passed by yeas

Gentlemen of the Senate :

We herewith return the House bill entitled, an Act to pay
a sum of money to William Price and Daniel R. Magruder,
and respectfully state that we cannot concur in the amend-
ment of the Senate to said bill, and request your Honorable
Body to recede therefrom.

Mr. Kimmel moved that the Senate recede from said
amendment;

And it was determined in the affirmative.

We have received your message, requesting the return of
the bill incorporating the Southern Maryland Railroad, here-
tofore passed by your Body. We respectfully decline to con-
cur therein because, at this stage of the session, the bill
