Mr. Davis, of Caroline—1.

Said bill was then sent to the Heuse of Delegates.
On motion by Mr. Bowie,

It was ordered, that it be entered on the journal, that had
Senator Stirling of Baltimore city been in his seat when the
vote was taken for United States Senator, he would have
voted for Philip Francis Thomas, of Talbot county.

On motion by Mr. Mackall,

Leave was granted to the Committee on Judicial Proceed-
ings, to introduce a bill to refund to G I. Simms, a sum of
money (taxes) erroneously paid into the Treasury.

The President announced the order of the day being

The bill entitled, an Act to repeal article 71 of the Code of
Public General Laws of the State of Maryland entitled, Oys-
ters, to re-enact the same with amendments,
Mr. Waters submitted the following amendment:
Amend section 8, by inserting in line 3, after the word
"samt," the words "or some Justice of the Peace, upon whose
certificate of the taking of such oath, the clerk shall issue
eaid license."

Which was read and adopted.

Mr. Waters submitted the following amendment:

Section 10, amend by inserting after the word "dollars in
line 6, "or forfeit the canoe or other boat so used or em-
ployed;"

Which was read and adopted.

Mr. Maddox; submitted the following amendment:

Line 1, section 22, strike out "Comptroller of the Treas-
ury" and insert the "Governor."

On the question being put, it was determined in the nega-
tive.

Mr. Maddox submitted the following amendment:

Section 22, line 5, strike out the words "for a period not
exceeding ten days at a time."

Which was read and rejected.

Mr. Maddox submitted the following amendment:

Section 29, line 9, before the word "provided" insert "and
that any other citizen of the county shall have power to lo-
cate and appropriate any waters in said county (five acres)
not located or appropriated by the 1st day of January, 1868;"

Which was read and adopted.
