said Turnpike Company shall have power to con-
struct bridges over streams, and may agree with
owners of lands for the purchase of land and ma-
terials for the use of said turnpike, and when
necessary by giving twenty days notice to the
interested parties may apply to a Justice of the
Peace of said County, who shall, issue a warrant
to the Sheriff of the County, to summon twenty
disinterested persons to meet upon said lands, and
after the striking off four such jurors by the Com-
pany, and four by the opposing party, the remain-
ing twelve on oath or affirmation shall value the
damages upon afair estimate of the advantage and
disadvantage to the owners of lands, and in writ-
ing shall deliver their verdict to the Clerk of the
Circuit Court of the County to be recorded, either
party having a right of appeal to the Circuit Court,
and the amount of damages to be paid by said
Turnpike Company to those for whose benefit such
damages are assessed, provided however, said
Company shall have the right to enter upon any
lands for survey preliminary to condemnation for
such service as described, the Justice, Sheriff,
Clerk and Jurors shall be entitled to receive the
usual fees in such cases. |
Tolls. |
Sec. 8. And be it enacted. That as said road is
finished and opened for travel, the said Company
shall be authorized to erect one or more toll-gates
thereon, and to charge and receive tolls at such
rates, terms and conditions and limitations as are
prescribed to the Baltimore and York Road Turn-
pike Company by their charter and supplements
thereto. |

Sec. 9. And be it enacted, That this act shall
take effect from and after the date of its passage,
and the General Assembly reserves to itself the
right to alter, amend or repeal this act at pleasure. |
