whether the said road is so far executed in a mas-
terly, workman-like manner, according to the time
intent and meaning of this Act, and if their report
shall be in the affirmative, then the Governor shall
by license under his hand and the seal of the State,
permit and suffer the said Company to erect and
place such and so many gates upon and across said
road as will be necessary and sufficient to collect
the tolls and duties granted to said Company by
this Act, from all persons using the same with
horses, wattle, wagons, carts, carriages and other
vehicles, sheep and hogs.

Sec. 9. And be it enacted, That the said Com-
pany having perfected the said road, and the same
being examined, approved and licensed in the man-
ner aforesaid, it shall and may be lawful for them
to appoint each and so many toll gatherers as they
shall think proper, to collect and receive of and
from all and every person using the said road, such
tolls and rates as the President and Directors may
think just and expedient not exceeding however
double the tolls and rates now prescribed and au-
thorized by law to be charged on the Baltimore
and Frederick Town Turnpike road by the Act of
eighteen hundred and four, chapter fifty-one, Sec-
tion twenty, and to stop any persons riding, lead-
ing or driving any horses, cattle, hogs, sheep or
any kind of chaise, cart, wagon, sled, carriage or
other vehicle of pleasure or burthen from passing
through the said gates, until they shall have paid
the same.

Sec. 10. And be it enacted, That if the said
Company, after the said road is completed as afore-
said, shall neglect to keep the same in good order
for the space of twenty days, and information shall
be given to any Justice of the Peace of the neigh-
borhood, he shall issue a precept to be directed to
any Constable, commanding him to summon seven
disinterested persons to be named by the said Jus-
tice in the said precept, to meet at a certain time
to be therein mentioned at the place or places in
the said road, which shall be complained of, of days prior
thereto, to the keepers of the gate nearest thereto,
and the said Justice shall, at the time and place<
aforesaid, on the oath or affirmations of the said
