the resources of the said company, first deducting
the current and probable contingent expenses of
the company, and shall apportion the same amongst
the stockholders in proportion to their respective
shares.

Sec. 18. And be it enacted, That in case any per-
son shall wilfully obstruct, injure, impair or de-
stroy any part of said Road, or any of the works,
buildings, carriages, vehicles, engines or machines
of said company, he, she or they for every offence
shall forfeit and pay to the said company or their
authorized agent or attorney, not less than fifty
dollars, which may be recovered in the name of
said company by action of debt in the County
Courts of the county wherein said offences shall be
committed, and shall also be subject to indictment
in the said court, and upon conviction of such
offence, shall be punished by fine and imprison-
ment, in the discretion of the court.

Penalties.

Sec. 19. And be it enacted, That the said com-
pany shall start and run their cars tor transporta-
tion of passengers and property at regular times,
to be fixed by public notice; and shall furnish
sufficient accommodation for the transportation of
all such passengers and property as shall, within
a reasonable time previous thereto, be offered for
transportation at the place of starting, and at the
usual stopping places established for receiving and
discharging way passengers and freight for that
train, and shall take, transport and discharge such
passengers and property at, and from, and to such
places on the due payment of the freight or fare
legally authorized therefor, and shall be liable to
the party aggrieved in an action for damages for
any neglect or refusal in the premises.

Shall provide
transportation.

Sec. 20. And be it enacted, That if the said road
shall not be commenced in five years from the pas-
sage of this Act, and shall not be finished in ten
years from the time of the commencement thereof,
then this Act shall be null and void.

Limitation.

Sec. 21. And be it enacted, That the General
Assembly reserves to itself the right to alter,
amend, or repeal this Act at pleasure.
