as he may deem it necessary; he shall see that
the ordinances are duly and faithfully executed.

Opening and
closing streets.

Sub-Sec. 42. Before the Mayor, Recorder and
Aldermen of the city of Annapolis shall pass any
ordinance to open, widen, close or discontinue any
new streets, lanes or alleys, or any part thereof,
in pursuance of the authority herein delegated, at
least thirty days notice shall be given before the
passage of such ordinance in some newspaper or
newspapers published in said city, and before any
street, lane or alley shall be so discontinued or
closed in whole or in part, the proprietors of lots
on any part or section of the streets, lanes and
alleys so to be discontinued or closed, in whole or
in part, whose property will be depreciated by the
act of the corporation, may apply to any Justice
of the Peace in said city, who is hereby empow-
ered, upon an affidavit of facts, to summon a jury
of twelve citizens, whose duty it shall be to exam-
ine the premises and assess the damages sustained
by the complainant; the full value of such assess-
ment shall be paid or tendered to the complainant
as hereinbefore provided, before the final execu-
tion of such ordinance.

Sec. 2. And be it enacted, That all acts, con-
tracts; deeds or ordinances of the Mayor, Record-
er and Aldermen of said city, heretofore made,
done, executed or passed in reference to the clos-
ing or discontinuance of any street, lane or alley
in said city, be and the same are hereby declared
and made operative and valid in the same manner
as if the said Mayor, Recorder or Aldermen had
full power and authority to do the same at the
respective times when the same were severally
done.

Sec. 3. And be it enacted, That this Act shall
take effect from the date of its passage.
