Sec. 23. And be it enacted, That it shall be the
duty of any officer having charge of or command-
ing such steamer, to take the person or persons so
arrester] and the boat or boats, vessel or vessels,
and other property so seized, into his custody, and
cause the said person or persons to be taken before
some Justice of the Peace for the county wherein
the offence may have been committed, and if the
offence shall have been committed outside of the
limits of any county, then to take the said person
or persons before some Justice of the Peace of the
county lying opposite and most convenient of
access from the place where such offence shall have
been committed; and it shall be the duty of the
Justice of the Peace before whom such person
or persons shall be taken by said officer to take
cognizance of the same, and docket a case or cases
in the name of the State against such person or
persons, and the said boat or vessel and the said
Justice shall proceed to try the same and render
judgment as provided by this Article.

Sec. 24. And be it enacted, That it shall be
the duty of any officer commissioned under the sec-
tion twenty-two of this Article to return to the
Comptroller, at the expiration of such cruise, the
said commission, with a full and particular
account of his proceedings thereunder, and the
names of the persons summoned to aid in its
execution, whereupon the Comptroller shall issue
his warrant to the Treasurer for the payment to
such officer such sum not exceeding five dollars
per diem, as may in the judgment of said Comp-
troller be deemed a fair equivalent for the services
performed, and to each of the persons summoned
by and aiding such officer a sum not exceeding
three, dollars per day for every such person who
may have been actually engaged in such service ;
and in addition thereto such officer and the per-
sons summoned by and aiding him in making any
arrests and seizures shall have such interest in the
fines and forfeitures which may result from the
arrest of persons and seizures of boats, vessels and
other property made by them whilst in the execu-
tion of such commission, as hereinbefore provided
for officers and those aiding them by section seven-
teen of this Article.
