dredge in taking or catching Oysters in any river,
creek, cove, inlet, bay or sound within the limits
of any county of this State, nor on any Oyster
bed, bar or rock. on or about Tally's Point, Sandy
Point, Hackett's Point, Thomas' Point, the
Three Sisters, Holland's, Point Bar and Plum
Point on the western side of the Chesapeak Bay,
and any owner, master, employee or other person
so offending, shall upon conviction thereof before
a Justice of the Peace or Judge of the Circuit
Court for any county wherein the offence may have
been committed, be subject to the same fine and
penalties, and the boat or vessel so used or employ-
ed, be liable to seizure and forfeiture as provided
iii section five of this Article, but this section nor
any in this Article shall be construed as a repeal
of sections ninety-four to one hundred and one in-
clusive, of Article ninety of the Code of Public
Local Laws for Somerset county, relating to Oys-
ters.

Sec. 16. And be it enacted, That it shall be un-
lawful for any person who may be licensed to take
or catch Oysters with rakes or tongs in the waters
of any county of this State, to take or catch Oys-
ters in the waters ,of any other county than the
one of which he is a resident and wherein the li-
cense may have been obtained, and any person vio-
lating the provisions of this section shall, upon
conviction thereof before any Justice of the Peace
of the county wherein the offence may have been
committed, be liable to the same fines and penal-
ties as provided in section ten of this Article;

Proviso.

provided, that when any river or creek is the di-
viding line between two counties, the bona fide re-
sidents of either of the said counties who may be
licensed as aforesaid, shall use the same without
incurring such fines and penalties; and provided,
also that Fishing Bay in Dorchester county shall
not be so used.

Sec. 17. And be it enacted. That all boats, ves-
sels or other property condemned under the pro-
visions of this Article shall be sold by the Sheriff
of the county where such boat, vessel or other pro-
perty may be condemned, at public sale, after giv-
ing twenty days notice of the time and place of
such sale by advertisement in one or more news-
