Office a re-survey upon an Escheat warrant for the
same Land, against which a caveat was entered
by said Thomas Devecmon, and upon a hearing
before the Commissioner of said Land Office, said
caveat of said Thomas Devecmon was ruled good ;
and whereas said John A. Smith obtained an Act
of the General Assembly, being Chapter ninety-
three, among the laws of eighteen hundred and
sixty-six, directing the Commissioner of the Land
Office to issue a Patent for said Land to said John
A. Smith, under the name of "St. Barts," and in
pursuance of said Act the Commissioner of the
Land Office did issue said Patent on the first day
of March, eighteen hundred and sixty-six; and
whereas said Act was passed upon misrepresenta-
tion to the General Assembly, and without notice
to the heirs at law of said Thomas Devecmon, de-
ceased; and whereas application has been made
to this General Assembly for relief in the premises;

Repealed. |
SECTION 1. Be it enacted, That said Act of
eighteen hundred and sixty-six, chapter ninety-
three, be and the same is hereby repealed, and that
said patent issued to said John A. Smith as aforesaid
be, and the same is hereby declared null and void. |

Sec. 2. And be it enacted, That the Commission-
er of the Land Office is hereby directed to notice
this Act upon the margin of the record of said
Patent to said John A. Smith. |
