CHAPTER 94. |

Entitled AN ACT to repeal sections five, six and
eight of Chapter twenty-four, passed at Decem-
ber session, eighteen hundred and thirty-five,
entitled, " An Act to authorize William Krebs,
Richard Linthicum and William Linthicum to
build a bridge over Gwynn's Falls, at or near
where the present bridge stands, known as the
Long Bridge," and to enact substitutes therefor. |
Section re-
pealed. |
SECTION 1. Be it enacted by the General assem-
bly of Maryland, That section five of Chapter
twenty-four of the laws passed at December ses-
sion, eighteen hundred and thirty-five, be and the
same is hereby repeated, and the following section
enacted in lieu thereof : |

5. That the said Mayor and City Council shall
pay to the owners of said bridge the full amount
of the value of said bridge, to be assessed at the
time the said Mayor and City Council shall assume
the control thereof, the said value to be ascer-
tained by arbitrators to be selected by the said
parties respectively, that is to say, the said Mayor
and City Council shall select one arbitrator, and
the owners of said bridge another arbitrator; and |

in case of disagreement said two arbitrators to
appoint an umpire; provided, the said Mayor and
City Council shall not assume control of said
bridge until the owners thereof shall have been
fully paid the amount of assessment therein pro-
vided for. |
Repealed. |
Sec. 2. And be it enacted, That section six of
said Act be and the same is hereby repealed, and
the following enacted in lieu thereof: |

6. The award and decision of such arbitrators,
under their hands and seals, shall be deposited in
the office of the Clerk of the Superior Court of
Baltimore city, and said award shall be final and
conclusive upon all parties, unless fraud can be
shown to have been perpetrated by the arbi-
trators. |
