were Patrick Hamill, Henry O. Hamill, Archibald C. Hamill,
Henry Hamill, Reasin Turner, Alexander Farrall, Richard
West and George O'Brian; their votes were challenged, and
they were told if they could take the oath, they could vote;
this they refused to do.

Cross-examination for Contestants.
1st Interrog. What party do you belong to ?
Answer. The Unconditional Union Party.
2d Interrog. Who challenged the parties named above?

Answer. A written challenge of all of the eight, was
handed to me on the morning of the election.

3rd Interrog. Were these parties not on the list, handed
the judges, by the register, as qualified voters?

Answer. Not to my knowledge.

4th Interrog. Did you perform your duty as one of the
judges, by looking at the list for the names?

Answer. Mr. Friend, one of the judges, examined the list,
I did not.

5th Interrog. When they offered their votes, did you reject
them?

Answer. I told them they were challenged and would have
to take the oath.

6th Interrog. Was there any-one at the window, outside,
to challenge them ?

Answer. There was not.

7th Interrog. Did yon not, previous to the election, deter-
mine not to receive Patrick Hamill's vote? Did you not know
that these parties were registered as qualified voters by Mr.
Wilson, in 1866?

Answer. I had not determined not to receive Patrick Ham-
ills, or any one's vote; I did not examine the list, and do
not know whether these parties were registered or not.

8th Interrogatory. Have you been sued for not receiving
votes at the election, November 6th, 1866.

Answer. I have.

EBENEZER KITZMILLER.

SAMUEL W. FRIEND, being sworn and examined by inter-
rogatories, deposes and says:

1st. Interrogatory. What is your age, occupation and resi-
dence?

Asnwer. I am 65 year? old, a farmer, and live in District
No. 1, Allegany county; Md.

2d Interrogatory. Did you act as one of the Judges in your
