William A. Bryden and John McElfiah had not the notice
served upon them respectively, as required by Article 35, sec-
tion 55, of the Code of Public General Laws.

3d. Because the notice as required by Article 35, section
59, of the Code aforesaid, was not served upon said Patrick
Hammil, William Devecmon, William A. Bryden and John
McElfish.

4th. Because the matters and things testified to by said
witnesses, is wholly irrelevant and illegal, in this; that said
matters and things, were not sufficiently set out in any notice
served upon said Patrick Hamill, William Devecmon, Wil-
liam A. Bryden and John McElfish.

5th. Becarse said testimony is in divers other respects ille-
gal and unlawful.

JOHN BRADY, being sworn and examined by interrogatories,
deposes and says:

1st Interrog. What is your age, occupation and residence?
Answer. I am 37 years old, a blacksmith and reside in Dis
trict No. 14, Allegany county, Maryland.

2nd Interrog. Were you one of the Registration officers,
in 1865, for District No. 14; if so, did you and your associ-
ates place the names of William Browning, Thomas Brown-
ing and Walter Wilburn, in column of "disqualified," on re-
gistration book of that year, and on what evidence ?

Answer. I was one of the Registration Officers for District
14, in 1865, and I, and the other officers placed the names of
William Browning. Thomas Browning and Walter Wilburn
in the column "disqualified" in the Registration books of that
year. The charges against them were for disloyalty under
the 4th section of Article 1st, of the Constitution of the State
of Maryland; after hearing the evidence of James Browning,
William McCabe, Archibald Castile, Singleton S. Wilburn
and Thomas Wilburn, we decided them disqualified and so
entered them.

3rd Interrog. Did you attend the 'election in District No.
14, on the 6lh of November last, as a Judge of Election; if so
did you refuse to receive the votes of said William Browning,
Thomas Browning and Walter Wilburn, and why?

Answer. I was Judge of the Election on the 6th of Novem-
ber last, in District No. 14; I refused to receive the votes of
the parties named, because being a register in 1865, and know-
ing the circumstances, I considered they were not entitled to
vote.

Cross-examined by the Counsel for the Contestants:

1st Interrog. Who was register in District No. 14,
