tried by a Court Martial or other court, and pronounced a
deserter ?

Answer. I do not know,

2d Interrog. Do you know this William Savage to be the
identical William H. Savage, who has heretofore testified in
this case ?

Answer. I do not know him to be the same person, at I
was not present at the time he testified; I now have no
knowledge or means by which I could identify him as the
person who testified in this case; I know nothing about his
testimony in this, case, except what I have heard.

JOHN M. ARMSTRONG.

The following testimony given at the office of Mr. J.
Brown, December 31st, 1866.

HENRY KLINE, witness for the contestants, being sworn,

and examined by interrogatories, deposes and says:

1st Interrog. What is your age, occupation and residence ?

Answer. I am 48 years old, gentleman, and reside in Dis-
trict No. 5, Allegany county, Maryland.

2d Interrog. Were you, registered as a voter ?

Answer. I was registered as a voter in 1866, by M. Atkin-
son.

3d Interrog. Did you attend the election on the 6th of No-
vember, 1866, and offer a ballot to the Judges of Election ;
for whom did you intend to vote for the House of Delegates ;
why was your ballot rejected ?

Answer. I attended said election, and offered my ballot to
the Judges; I intended to vote the full Democratic for the
Houae,-G. W. McCulloh, Wm. Devecmon, Jno. McElfish,
Wm. A. Bryden and Pat'k Hammill; and the Judges would
not allow me to vote; I was not allowed to vote because I ap-
peared before the registers in 1865, and would not take the
oath, which I did riot understand.

HENRY KLINE.

At the town of Oakland, Allegany county, Maryland, on
on the 4th day of January, 1867, the following depositions
were taken; after swearing George S. R. Knorr, as Clerk.—
The Contestants not being represented in person or by At-
torney:

JAMES CHISHOLM, SR., being sworn and examined by inter-
rogatories, deposes and says :

1st Interrog. What is your age, occupation and residence ?

Answer. I am 65 years of age; my occupation is milling;
