By Mr. Devecmon :

1st Question. What is your name, age, residence and oc-
cupation ?

Answer. My name is Ralph Thayer Browning; age, 29;
live in District No. 15, Allegany County, Maryland, and by
by occupation a farmer.

2d Question. When did you registered ?
Answer. In September, 1866, in District No. 15.

3d Question. Did you attend the election held in District
No. 15, Allegany County, Maryland, November 6,1866; did
you offer to vote; was your vote refused or accepted, and
whose names were on your ticket as candidates for House of
Delegates?

Answer. I attended said election; offered to vote, but my
vote was rejected. The Judges said I could not vote unless
I would take the oath, and I refused to take it. The names
of the parties on my ticket as candidates for House of Dele-
gates were William Devecmon, William A. Bryden, John
McElfish, Patrick Hammil and George W. McCulloh.

Cross-examined by Mr. Brown.

1st Question. Why did you not register in 1865 ?

Answer. I did not offer, had done nothing to disqualify me
from registering, but did not care about voting then. I took
no part in the war.

Deposition No. 38.

JOHN GOWER, SR., being duly sworn, deposed and said as
follow, to wit:

By Mr. Devetmon:

1st Question. What is your name, age, residence and occu-
pation ?

Answer. My name is John Gower, Sr., age 70, live in Dis-
trict No. 10, Allegany county, Maryland, and a farmer by .
occupation.

2nd Question. When did you register ?
Answer. In September 1866, in District No. 10.

3rd Question. Did you attend the election held in District
No. 10, Allegany county, Maryland, November 6, 1866; did
you offer to vote; and was your vote accepted or rejected; and
whose names were on your ticket as candidates for House of
Delegates?

Answer. I attepded said election, offered to vote, but the
Judges refused my vote, because I would not take the oath
