Cross-examined by Mr. Brown.

1st Question. Why did you not register in 1865.

Answer. My reason was the same as that of Mr. Arnold
and Mr. Kitzmiller.

PETER KNEPP:

Deposition No. 26.

WILLIAM BROWNING, SR., being duly sworn, deposed and
said as follows, to wit:

By Mr. Devecmon.

1st Question. What is your name, age, residence and occu-
pation ?

Answer. My name is Wm. Browning; age 62; live in Dist.
No. 14, Allegany county, Md., and by occupation a farmer.

2d. Question. When did you register ?

Answer. In September, 1866, in District No. 14.

3d Question. Did you attend the election held in District
No. 14, in Allegany county, November 6, 1866; did you offer
to vote; Was it refused or accepted; whose names were on your
ticket as candidates for House of Delegates ?

Answer. I attended said election, offered to vote, but the
Judges refused my vote, saying there were charges of dis-
loyalty against me, and that the registers had no rig ht to
register me; they did not ask me to take any oath; I was
always loyal and am now, and had a son in the Union army;
the names of the parties on my ticket as candidates for
House of Delegates, were Wm. A. Bryden, Wm. Devecmon,
John McElfish, George W. McCulloh, and Patrick Hammil.

Cross-examined by Mr. Brown.

1st Question. Why did. you not register in 1866 ?
Answer. Because the Registers Would not register me.

Re-examined by Mr. Devecmon.

1st Question, did any one else offer to vote, and was he re-
fused, and was he registered ?

Answer. There was Walter Wilburn, a very old man una-
ble to get here, was registered, offered to vote and was refused;
he would vote for Wm. Devecmon, Wm. A. Bryden, Patrick
Hammil, John McElfish, and John W. McCulloh, as candi-
dates for House of Delegates. Mr. Wilburn is between 80
and 90 years of age; I was present when Mr. Wilburn offered
his vote.
