in District No. 10, Allegany County, Md.. and a shoemaker
by trade.

2d Question. When were you registered?
Answer. In September, 1866, in District No. 10.

3d Question. Did you attend the election held in District
No. 10, Allegany County, on November 6, 1866; did you
offer to vote, was your vote atcepted or refused, whose names
were on your ticket as candidates for House of Delegates ?

Answer. I attended said election; offered to vote; but
the Judges refused my ticket, saying there was a witness
against me, who said I was guilty of piloting rebels; I called
for the name of the witness; they gave it. I then brought
up the witness whom they had named. He denied he had ever
made any such charge, and said that he would swear before
the Judges, that he had never made any such charges. They
refused to let me in the election room with my witness, and
would not examine said witness; the witness was Alexander
Kitzmiller; the Judges never offered me any oath; the names
of the parties on my ticket as candidates for House of Dele-
gates were Patrick Hammil, George W. McCulloh, William
Devecmon, William A. Bryden and John McElfish.

4th Question. Was there any armed men at the polls No-
vember 6, 1866, and had they a tendency to intimidate voters?

Answer. There was an armed force there, two guarding the
door; I do not think they intimidated any one, at least they did
not me. The Judges made no objection to the armed force
being there; these armed men made no attack on any one,
and made no use of the weapons except to hold them in a
military attitude.

Cross-examined by Mr. Brown.

1st Question. Why did you not register in 1865?

Answer. Because I did not like the registers; one of them
lost his wife by death, then in a week or two married his wife's
sister who had four children, one of which was a mulatto, and
no such man chpuld register me.

WILLIAM H. KITZMILLER.
