TESTIMONY.

{Excepted to as not in the notice, by A. Spates.)

SAMUEL W. FRIEND, sworn.

Interrog. 1st. As No. 1 in schedule A.

Samuel W. Friend; age 55 years; occupation farmer; resi-
dence, Election District No. 1, Allegany county, Maryland;
have resided there 19 years.

Interrog. 2d. As No. 2 in schedule A.

I was appointed, I qualified and acted as such for the year
1865. I had read the law and Constitution. I did. I gave
notice as required by law.

Interrog. 3d. Did the officers enter on said book the names
of any persons as disqualified under the provisions of the
Constitution; if so, name them ?

Answer. Yes; we aimed to do so. We entered Henry
Hamill in the 7th column as disqualified, and Randolph Beck-
man, and we entered Alexander Farall and William Rein-
hart as disqualified for refusing to take the oath; also Pat-
rick Hamill, as generally known as disloyal, but did not enter
the testimony; George O'Brien as disloyal, as giving aid and
comfort. I think there were more, but do not recollect them.

Interrog. 4. As No. 2 in schedule B.

I received the appointment. I qualified and acted as such.
No, not all persons, were informed by public notice that they
would be required to take the oath. We had no armed men
at the polls, and did not authorize any, and there were none
there.

Interrog. 5. As No. 3 in schedule B.

No, not a single man. We did not refuse any man's vote
without requiring them to take the oath.

Interrog. 6. As No. 7 in schedule B.

I voted for Dr. Ohr for State Senator. The polls were
held at the place as published by law, by the Sheriff.

Interrog. 1. Did you give the persons whom you, as Reg-
ister, in 1865, entered as disloyal and disqualified, notice to
appear when their case was to be investigated, confront them
