Question. What is yottr name, age, occupation and resi-
dence ?

Answer. My name is Theodore A. Ogle; age 40 years; oc-
cupation saddle and harness maker; residence, Cumberland,
Maryland.

By Mr. Spates:

Question. Did you or did you. not examine and count cer-
tain ballots and inspect the poll books filed therewith in the
office of the Clerk of the Circuit Court for Allegany County,
on the 17th day of November, 1866; if yea, state at whose
instance you did so, who assisted you and what was the result
of such count and inspection; state your knowledge fully ?

Answer. On the 16th day of November, 1866, I was in-
vited by Colonel A. Spates to come to the Clerk's Office of
Allegany county, on the 17th of the same month, to assist
in recounting and inspecting the ballots of the sixteen Elec-
tion Districts of said county, to ascertain the number of votes
given for Dr. C. H. Ohr and Colonel A. Spates, respectively,
for State Senator, at the recent election in Maryland; I came
to the office on said day as requested, and assisted Messrs.
H. D. Carleton, A. M. Adams, J. H. Young, T. E. Gonder
and George W. Hoover, the latter of whom acted as a teller
with myself. The ballots were counted by the above named
parties in the presence of Messrs. Bean and Bevans, Deputy
Clerks, with the result as already given by the other wit-
nesses examined here to-day. I kept one of the tallies now
here exhibited, with my name endorsed thereon, in my own
handwriting, and I now file with the Justice of the Peace
the tally so kept by me as aforesaid.

posed and said as follows, to wit:

Answer. My name is George W. Hoover; age 38 years;
occupation, Register of Wills for Allegany county; residence
Cumberland, Maryland.

By Mr. Spates:

Question. Did you or did you not examine and count cer-
tain ballots and inspect the poll books filed therewith in the
