Question by Mr. Spates :

What is your name, age, occupation and residence, and
how long have you lived there ?

Answer. My name is David A. Gauer, age 21 years in
March, 1866, occupation farmer, and live in Election District
No. 10, in Allegany county, Maryland, and have lived there
ever since I was born.

Question by Mr. Spates :

Were you registered as a voter prior to the election held in
said county on the 6th day of November, 1866 ?

Answer. I was; in September, 1866.

Question by Mr. Spates :

Did you or not attend at the polls in said election district
in Allegany county on the 6th day of November, 1866; if so,
did you then and there offer a ticket to the Judges of Election
at said polls as your ballot, and was it received or rejected;
state also the name of the person printed on said ticket for
State Senator, for whom you desired to vote; and what rea-
son did the said Judges assign for rejecting your vote, if they
did so reject it.

Answer. I attended at the polls on that day, and I offered
a ticket as my ballot to the Judges of Election, and it was
refused by them. The name printed on my ticket so offered
was Alfred Spates, for State Senator; the Judges did not
assign any reason for refusing my vote.

Gross-examined by Dr. Ohr.

By Dr. Ohr:

Did or did not the Judges of Election, in November, 1866,
demand of you to take the oath prescribed in the Constitu-
tion, Article 1, section 4, before deciding upon your right to
vote ?

Answer. I offered my ticket at the window where votes
were taken, and they told me to come around inside into the
house; and I refused to do so, saying, if they could not take
it there, they could not take it inside; they refused to take
it, and I went away without voting; they did not say why
they wanted me inside.
