ber, 1866; if so, did you then and there offer a ticket to the
judges of election, at said polls as your ballot, and was it re-
ceived or rejected; state also the name of the person printed
on said ticket' for State Senator, for whom y6ii desired to
vote; and what reason did the said judges assigh for rejecting
your vote, if they did so reject it?

Answer. I attended the polls on that day in District No.
10, I did not offer rny ticket to the judges of election, because
I saw others go up to vote, that were objected to and who did
not get their votes. These parties did not get their votes be-
cause they refused to take the oath required of them by the
judges of election; and I would not take the oath and there-
fore did not offer rny vote. The name of Alfred Spates was
printed on the ticket that I desired to vote, for State Senator.

By Mr. Spates:

Question. Was there or not a rule adopted by the judges
of election in District No. 10, and announced to and known
by persons generally in said district, that no one should vote
without taking the oath before the said judges, who had been
registered in 1866.

Answer. My father told me there was such a rule, and that
is the reason I did not offer my vote.

William Moon, having been by me duly sworn, deposed
and said as follows, to wit:

By Mr. Spates:

Question. What is your name, age, occupation and resi-
dence, and how long have you lived there?

Answer. My name is William Moon, age 53 years, occu-
pation farmer, reside in Election District No. 10, in Allegany
county, Maryland, and have done so all my life time.

By Mr. Spates:

Question. Were you registered as a voter prior to the elec-
tion in Allegany county, November 6th, 1866?

Answer. I was registered in September, 1866.

By Mr. Spates:

Question. Did you or not attend at the polls in said Elec-
tion District in Allegany county, on the 6th day of November,
1866; if so, did you then and there offer a ticket to the judges
of election at said polls, as your ballot, and was it received
or rejected; state also the name of the person printed on said
ticket for State Senator, for whom you desired to vote; and
what reason did the said judges assign for rejecting your vote,
if they did so reject it?
