Cross-Examined by Dr. Ohr.

By Dr. Ohr.

Question. Why did the Judges say vou could not vote
there?

Answer. They said there were witnesses againt me—that
I was disloyal.

By Dr. Ohr:

Question. Do you or do you not know that you had then
been registered as disqualified for disloyalty ?

Answer. I know that I saw my name on the registration
book with the word "disloyal" after it; this was in 1866,
when I was registered. I never applied to be registered until
September, 1866.

By Mr. Spates:

Question. What efforts, it any, did you make to obtain
your vote after the Judges had refused it, as detailed above ?

Answer. I then called again upon them and insisted upon
knowing their reasons why I should not vote. When they
answered they said, "there was a witness against me who said
I was guilty of piloting Rebels." I brought the witness
they named to the door of the room in which the Judges
were. I called to the Judges for admission, and they an-
swered that the door was bolted. I then went to the window
where the Judges were and they refused to admit me, after I
had asked them to let me in with my witness, Alexander
Kitzmiller, to disprove the charge against me. I told them
I had Alexander Kitzmiller there to disprove the charges
they had against me. Alexander Kitzmiller was the witness
they named as the one making the charge against me of pi-
loting the Rebels. The reason I took Kitzmiller with me to
the Judges was, that he told me there that he had not made
any such charge, and would go before them and swear that
he did not make any such charge. When I went to the door
of the room where the polls were held it was guarded by two
armed men, John Chisholm and Beckwith Shrout, who both
belonged to the Radical party. When I failed to get before
the Judges I left without voting.

JACOB SHAFFER, having been by me duly sworn, deposed
and said as follows, to wit:

By Mr. Spates:

Question. What is your name, age, occupation and resi-
dence, and how long have you resided there ?

Answer. My name is Jacob Shaffer; age 63 years; occupa-
tion wheelwright, and reside in Election District No. 10, in
Allegany county, Maryland, and have lived there for the last
three years and a half.
