Deposition No. 11.

HENRY HAMILL, having been by me duly sworn and exam-
ined, deposed and said as follows :

By Mr. Spates :

Question. What is your name, age, occupation and resi-
dence ?

Answer. My name is Henry Hainill, age 68 years, occupa-
tion, farming, and reside in Election District No. 1, in Alle-
gany county, Maryland, and have lived in Allegany county
forty-five years.

By Mr. Spates:

Question. Were you registered as a voter prior to the elec-
tion held in Allegany county, on the 6th of November, 1866?

Answer. I was.

By Mr. Spates.

Question. Did you or not attend at the polls in said Election
District, in Allegany county, on the 6th day of November,
1866, if so did you then and there offer a ticket to the Judges
of Election at said polls, as your ballot, and was it received
or rejected, state also, the name of the person printed on said
ticket for State Senator, for whom you desired to vote, and
what reason did the said Judges assign for rejecting your vote,
if they did so reject it ?

(Objected to by Dr. Ohr.)

Answer. I went to the polls on that day to vote, and offer-
ed my ballot to the Judges of Election and they rejected it;
My ticket had on it, for State Senator, the name, of Alfred
Spates; they gave me no reason, they said I was challenged,
I asked who challenged me, they said they did nqt know,
they then held a consultation in one corner of the room, in
which the polls were held, and I asked them to decide, they
came forward and said they had decided against me; I asked
upon what ground, and one of them pointing to the papers on
the table, said, upon that there; I asked them what that was,
the reply was, "I don't know."

. Cross-examined by Dr. Ohr.

By Dr. Ohr:

Question. When were you registered as a voter?
Answer. In 1866, sometime in September.
By Dr. Ohr:

Question. Did you apply for registration in 1865?
Answer. I did not sir.
By Dr. Ohr:

Question. Do you or not, know that you had then been
registered as disqualified for disloyalty ?
