Answer. My name is Francis Martin, age 44 years, occu-
pation farmer, and reside in District No. 10, in Allegany
county, Maryland, and have done so for over thirty years.

By Mr. Spates :

Question. Were you registered as a voter prior to the elec-
tion held in said Allegany county, on the 6th day of Novem-
ber 1866?

Answer. I was.

Question by Mr. Spates :

Did you or not attend at the polls in said election District
in Allegany county, on the 6th day of November, 1866 ? If
so, did you then and there offer a ticket to the judges of elec-
tion at said polls, as your ballot, and was it received or re-
jected? State also, the name of the person printed on said
ticket, for State Senator for whom you desired to vote; and
what reason did the judges assign for rejecting your vote, if
they did so reject it?

(Objected to by Dr. Ohr.)

Answer. I went to the polls on said day and offered my
ballot to the judges of election, and they refused to take it. I
intended to vote for Alfred Spates for State Senator. The
reason they assigned for not taking my ballot was that I had
to be sworn before them, the same as I was before the Re gis-
ter, and this I refused to do.

Cross-Examined by Dr. Ohr.

Question by Dr. Ohr :
When were you registered as a voter ?
Answer. About the 11lth of September, 1866.
Question by Dr. Ohr :
Did you apply for registration in 1865 ?
Answer. I did not.
Question by Dr. Ohr :

Do you or not know that you had then been registered as
disqualified for loyalty ?

(Objected to by Mr. Spates.)

Answer. I did not know it until I went to be registered in
September, 1866, when I saw my name in the book thus :
"Francis Martin, refused to take the oath."
