CUMBERLAND, ALLEGANY CO., MD.,

December 29th, 1866.
To the Presiding Officer of the

Senate of the State of Maryland:

SIR:—In accordance with the provisions of the 61st section
of the 35th Article of the Mary lurid Code of Public General
Laws, I herewith transmit the certificates of notice and proof
of the service of the same, and the depositions taken in the
contested election case therein named.

Depositions taken before me, Joseph M. Strong, a Justice
of the Peace of the State of Maryland, in and for Allegany
county:

Be it remembered, and I hereby certify, that on the twen-
ty-third day of November, 1866, was filed with me a paper
containing a notice, certificate and affidavit; which paper is
herewith filed, marked "Exhibit No. 1."

(See "Exhibit No. 1.")

And on the day of the filing with me by Alfred Spates, of
the paper aforesaid, the said Alfred Spates applied to me, Jo-
seph M. Strong, Justice as aforesaid, to take testimony to be
used in the above entitled case.

And thereupon, I issued the following notice, to wit, with
certificate and affidavit endorsed thereon, and herewith filed
as part of this record, and marked "Exhibit No. 2," and
which, with all other exhibits herewith also filed, is to be ta-
ken and considered as part of this record.
