pensation to be made to the said Thomas Lusby,
John Haddaway and Samuel Franklin Smith, be
and the same is hereby opened, and that George
W. Spencer, Richard C. Johnson and William T.
Spry, of Kent county, be and they are hereby ap-
pointed a Board of Commissioners to go upon and
examine the said road and landing as located on
the lands of said Thomas Lusby, John Haddaway
and Samuel Franklin Smith, and to value and
assess the damages sustained by them in conse-
quence of said location, additional fencing and in-
conveniences, and take into consideration all the
advantages and disadvantages attending the same,
and to make return to the County Commissioners
aforesaid by the first day of June next, and that
before entering upon their duties they shall take
an oath before some Justice of the Peace of Kent
county to value and assess the said damages ac-
cording to their best skill and judgment, and shall
make return thereof to the said County Commis-
sioners, who shall immediately levy and assess the
same and all costs and expenses attending the
same, including two dollars per day for each of
the said Commissioners, the award or return of any |

two of them to be final and conclusive; and pro-
vided, that this Act shall not delay the making of
the said road. |
Gates to bo
removed. |
Sec. 2. And be it enacted, That the gates on the
said road shall be removed by the first day of Jan-
uary next, and this. Act shall take effect from the
date of its passage. |
